Terence LUK

Terence is a partner with Zhong Lun's dispute resolution team. He has extensive experience in all types of dispute resolution including shareholders' disputes, commercial litigation, cross-border arbitration, receivership, liquidation, bankruptcy, divorce, custody, wardship, guardianship, mediation, applications related to Mental Health Ordinance, professional misconduct, defamation, shipping, contentious probate matters, commercial fraud, disciplinary proceedings, regulatory, and criminal matters. Terence has represented companies listed on HKSE and NASDAQ, real estate developers, local and international banks, and financial institutions, multijurisdictional corporations, charitable organizations, NGOs, government officials, celebrities, and ultra-high-net-worth individuals. Terence has participated in legal proceedings across different jurisdictions, viz. Hong Kong SAR, the mainland of China, Canada, USA, BVI, Bermuda, and Panama.
Prior to joining Zhong Lun, Terence had worked with Fairbairn Catley Low & Kong for over 22 years, 17 of which, he served as a partner.

Representative Matters

  • Represented a listed company and its group in successfully opposing appointment of receivers and joint provisional liquidators and initiation of winding-up proceedings across different jurisdictions including Hong Kong and Bermuda, involving assets at dispute exceeding HKD 15 billion

  • Represented a billionaire in bankruptcy proceedings including setting aside statutory demands issued against him on alleged indebtedness exceeding HKD 10 billion

  • Represented an NGO in obtaining a favorable judgment from the High Court in a high-profile defamation claim and successfully liquidated the company defendant for its failure to settle the judgment sum

  • Represented a listed company in cross-border arbitration proceedings involving Hong Kong, BVI, and the mainland of China in relation to a claim in excess of HKD 1.2 billion

  • Represented former directors in proceedings arising from their alleged breach of directors' duties involving a cross-border golf and country club and a well-known listed company

  • Advised on professional negligence and disciplinary proceedings involving medical practitioners, accountants, social workers, liquidators, and receivers

  • Represented former chairman, secretary, and treasurer of a management committee of the incorporation of owners and successfully defended against their alleged breach of duties of management committee members by entering into a maintenance contract without requisite authority

  • Represented private and corporate clients in recovery of entitlement in landed properties before the Court of Final Appeal and the Court of Appeal 

  • Represented one of the world's top food manufacturers in a defamation claim against a major local newspaper and successfully obtained written apologies from the defendant

  • Represented renowned multinational shipping corporations in Admiralty List cases involving proceedings in Hong Kong and other jurisdictions and successfully struck out the plaintiffs' claims

  • Represented the lawful wife as the petitioner in a highly contentious divorce suit against the husband coinciding with another woman claiming to be the husband’s initiating separate divorce proceedings against the husband and conducted extensive asset tracing across Hong Kong, the US, and the mainland of China

  • Represented a celebrity in disputes concerning access and maintenance of her minor child against the father, who is a senior counsel 

  • Represented an ultra-high-net-worth businessman in his son's ancillary relief proceedings involving assets of over HKD 4 billion

  • Represented an individual in applying to the court to remove his minor child out of the jurisdiction of Hong Kong for immigration purposes, involving disputes over the appointment of a child psychologist

  • Represented an individual in successfully defending against his ex-wife claim for a dishonored cheque issued as part of a settlement agreement

  • Represented clients in applying for ouster orders and non-molestation orders in matrimonial and other civil proceedings

  • Represented an NGO in wardship proceedings, which lasted eight years and involved neglect/abuse of an illegitimate Non Refoulement Claimant minor, and adoption proceedings 

  • Represented a grandparent of a minor in successfully obtaining the guardianship order when the minor's parents relinquished their roles in the minor's care and control

  • Advised on Mental Health Ordinance related proceedings including representing family members of the Mentally Incapacitated Persons (“MIP”) to apply to court to form committees to manage the financial matters of the MIPs

  • Represented the Official Solicitor on numerous occasions in seeking recovery of assets on behalf of the MIPs in divorce proceedings or from their family members and third parties

  • Represented parents of an MIP in applying to the Guardianship Board for an order to make urgent medical decisions on behalf of the MIP

  • Represented the executor in contentious probate proceedings and successfully obtained the Grant of Probate by striking out the defendant's alleged Letters of Administration

  • Represented clients in making beddoe application and represented beneficiaries in challenging the authenticity of a will and successfully obtained favorable results through mediation

  • Advised a potential administrator in contentious probate proceedings in relation to an estate involving assets across the world exceeding HKD 6 billion

  • Represented a client in successfully defending against claims made by executors of the estate of the former chairman of a top real estate developer, who demanded return of ultra-high-value inter vivos gifts 

  • Represented private clients and eminent charitable organizations in both seeking or contesting applications for relief made pursuant to the Inheritance (Provision for Family and Dependents) Ordinance

  • Advised shareholders of an acclaimed interior design company and a well-established electric fan manufacturer on shareholders' disputes involving removal of directors and winding-up proceedings

  • Represented the seller in a merger and acquisition dispute and successfully defended against the buyer's claim for damages of over HKD 50 million for breach of representations and warranties  

  • Represented senior bankers and top executives of multinational organizations/listed companies in restrictive covenants and employment issues

  • Represented private clients and insurance companies in personal injuries proceedings (including claims against Hospital Authority and medical practitioners)

  • Initiated ex-parte and inter-partes injunctions, Anton Piller Orders, and other enforcement proceedings on behalf of private and corporate clients including NGOs

  • Advised major banks and financial institutions, multinational courier companies, and a leading camera manufacturer on enforcement proceedings including charging orders, garnishee orders, mortgagee action, receivership, and liquidation

  • Represented clients in criminal investigations and proceedings conducted by the Hong Kong Stock Exchange, Securities and Futures Commission, Independent Commission Against Corruption, Commercial Crimes Bureau of the Police, Customs and Excise Department, etc.

  • Provided retainer-based legal services to a global leading traditional Chinese medicine research and development company and assisted the client in successful listing on NASDAQ
