Huimin XIA

Mr. Xia started his legal career in 2000. He has served as a prosecutor for two years in Beijing and thereafter 20 years as a dispute resolution lawyer, possessing outstanding professional capabilities and extensive practical experience in the fields of litigation and arbitration, criminal risk management, and criminal defense. Most noteworthy is his astuteness in handling investment disputes and high-profile, complex cases involving both civil law and criminal law elements. Over the past 10 years, Mr. Xia has counseled on a significant number of investment dispute cases that have significant impact. With a keen eye for key issues in disputes, he successfully handled these challenging cases, whether through litigation, arbitration, enforcement, take-over, criminal procedures, or other proceedings, and achieved satisfactory results for clients, earning their recognition.

  • Advised Fujian Gusheng Investment Co., Ltd. and Mianyang High-tech Zone Kechuang Industry Co., Ltd. in the retrial proceedings of a share subscription and investment dispute before the Supreme People's Court

  • Represented group companies of PKU Founder Group in an equity investment dispute before Jiangsu High People's Court and the Supreme People's Court

  • Represented an industrial investment fund of the Three Gorges Group in a forward equity transfer agreement dispute before Beijing Arbitration Commission (“BAC”)

  • Represented a private equity investment fund of China Cinda in a share redemption dispute before China International Economic and Trade Arbitration Commission (“CIETAC”)

  • Represented a number of funds managed by Source Capital in a share redemption dispute before CIETAC


Criminal Risk Management

  • Advised and defended a former director of Jiangxi Provincial Development and Reform Commission in the criminal prosecution of the client for alleged accepting bribes and offering bribes to a high-ranking deputy of a national government agency

  • Advised and defended the senior management of Tianjin Port Group in the criminal prosecution of the clients for dereliction of duty concerning the Tianjin Port Explosion

  • Provided legal advice and criminal defense to a former officer of Hunan Infrastructure Investment Group in a series of criminal bribery cases

  • Provided legal advice to and defended many entities and their actual controllers and senior management in criminal investigations and litigations concerning economic crimes and abuse-of-power crimes

  • Advised many clients in relation to criminal risk management issues in business operation

  • Represented a number of clients in the criminal report and accusation they lodged against other parties suspect of corruption and bribery, embezzlement, contract fraud, endangering tax administration, infringement of intellectual property rights, etc.
