Zhong Lun International Trade Law Team Wins an Appeal before the General Court of the European Union
On February 17, 2011 the General Court of the EU ruled for Zhejiang Xinshiji Canned Mandarins Co., Ltd. The Court supported one of the 5 argument points of 3 main pleas put forward by the concerned company that the EU Council of Ministers failed to provide adequate reasoned explanations on certain issues claimed by the company. Consequently, the EU Regulation imposing definitive measures on imports of canned mandarins from China, in so far as it is concerned Zhejiang Xinshiji, was annulled. The EU Council of Ministers has 60 days to decide whether it is going to appeal to the Court of Justice of the EU.
During the course of the investigation, Zhong Lun Law Firm acted as legal counsel for the company concerned and raised several arguments to the EU investigating authority, but were refused to be taken into account. In this appeal, Zhonglun Law Firm assisted Baker & Mackenzie in Brussels and won at this stage.
