On October 11, 2013, KOSDAQ-listed China Food Packaging Incorporation Limited was privatized through tender offer from the newly established entity by its original controlling shareholders and was successfully delisted from KOSDAQ. Ascendent Capital had financed such privatization by means of convertible notes.
Zhong Lun had acted as the PRC counsel for Ascendent Capital in this transaction. The legal team from Zhong Lun was led by partner lawyer Anthony Zhao, and included William Jia, Shen Jun and Vega Huang. This transaction may indicate the beginning of PE-backed privatizations of China-based Korea-listed companies.
