ZHONG LUN Law Firm succeeded in helping iQIYI win
Recently, Shanghai Intellectual Property Court concluded the final judgment for the case of iQIYI Company v. Hangzhou Feiyi Company, Mr.Lv and Mr.Hu over unfair competition. The court held that the three defendants, as operators of increasing video clicks through technical means, knew that fake video views would mistakenly enhance the public's awareness of the quality, quantity and attention of videos, resulting in misleading consequences of false propaganda, but still accepted the commission and increase video clicks illegally. This action belongs to "helping others to carry out misleading false propaganda", thus the court ordering the three defendants to make joint and several compensations for the economic losses of iQIYI Company, and publishing a statement in "Legal Daily" to eliminate the impact.
The project team of Yuanchao MA who is the equity partner of ZHONG LUN Law Firm, has creatively completed the fixed evidence of 960 million fake views made by the three defendants, not only proved to the court the illegitimate behavior of the three defendants, but also successfully persuaded the court to investigate the tort liability of Feiyi Company’s shareholders Mr.Lv and Mr.Hu, piercing the "corporate veil" and effectively deterred “illegal industry of fake video views."
The phenomenon of making fake online video views by the “Click Farmer" has been criticized for a long time. The case was praised by the mainstream media as "the first case of unfair competition against Video Click Farmer in China" after the judgment of the first instance, which has great significance for purifying the online video industry.
