Zhong Lun Assisted Baisheng in Winning Three Patent Infringement Appellate Cases
Zhong Lun Law Firm assisted Shaoxing Baisheng Cultural and Educational Products Co., Ltd. (“Baisheng") in dealing with three patent infringement appellate cases before the IP Court of the Supreme People’s Court (“IPC of SPC"). The three patent infringement cases include two cases appealed by Baisheng and one case appealed by the opposite party. Recently, IPC of SPC rendered the final judgments for the three cases above. For the two cases appealed by Baisheng, IPC of SPC reversed the first instance judgments and supported Baisheng’s appellate petitions. For the case appealed by the opposite party, IPC of SPC affirmed the first instance judgment. The key issue in the three cases is about the infringement under the doctrine of equivalents. IPC of SPC agreed with Zhong Lun Law Firm’s opinions of the infringement under the doctrine of equivalents, and held that Baisheng did not infringe the asserted patents.
