Zhonglun Won the Trademark Infringement Case for Sunac Group
In 2018, a well-known pan-technology website considered that Sunac Group parent-child activity brand "GuoKe Project" infringed its registered trademark rights, then filed a trademark infringement lawsuit to demand Sunac Group’s compensation of 10 million yuan.
Zhong Lun Law Firm represented Sunac Group in the first and second instance trademark infringement litigations before Guangdong Higher People's Court and Shenzhen Intermediate People's Court. Recently, Guangdong Higher People's Court rendered the final judgment, upheld that Sunac did not infringe the asserted trademarks.
The key issue of this case is about services in class 35. Zhong Lun conducted a detailed and comprehensive analysis of the nature of the behaviors involved. Guangdong Higher People’s Court finally fully supported Zhong Lun’s point of view and determined that the involved behaviors different from service “marketing" in class 35. Zhong Lun won the first and second trials, and Sunac Group ultimately did not have to bear RMB 10 million in compensation.
