Zhong Lun Represents Client in UK Anti-Dumping Transition Review on Certain PSC Wires and Strands and Secures a Complete Victory
In August 2021, the UK government published the final determination of transition review on anti-dumping duty on certain pre- and post-stressing wires and wire strands of non-alloy steel (PSC wires and strands) originating in the People's Republic of China. The final determination revoked the current anti-dumping measure, and no more anti-dumping duty will be levied on the same products exported from China to the UK in the future. Zhong Lun helped the client win a favorable result, and this is the only transition review in which the UK government has determined to revoke anti-dumping duty so far.
On July 30, 2020, the UK Secretary of State for International Trade published a notice to initiate the anti-dumping transition review on imports of certain PSC wires and strands originating in China (“Products Concerned"), in order to determine whether it is appropriate to maintain the anti-dumping measure previously imposed by the European Union on the Products Concerned in the UK after the UK left the EU. This transition review was carried out by the UK Trade Remedies Authority (“TRA").
According to publicly available information, China’s export of the Products Concerned to the UK during the investigation period exceeded RMB 300 million.
Ms. Song Lei, a senior counsel of Zhong Lun, led a team to represent a Chinese listed company to respond to this transition review and provided full legal services to the client. The transition review lasted one year from the notice of initiation to the issuance of the final determination, during which period it has undergone procedures including original investigation questionnaire, supplemental questionnaire, economic interest test, disclosure of essential facts, final determination, etc. In August 2021, the TRA formally published the final determination of this transition review.
In the final determination, the TRA decided to revoke the anti-dumping measure against the Products Concerned. Zhong Lun has assisted the client to secure a complete victory in this transition review, and no more anti-dumping duty will be levied on the Products Concerned exported to the UK in the future. Before the final determination of this transition review to revoke the anti-dumping measure, all Products Concerned exported to the UK were subject to an ad valorem anti-dumping duty of as much as 46.2%, which placed a very heavy burden on Chinese companies.
Zhong Lun achieved three “firsts" in taking on this transition review:
· The first UK transition review to which a Chinese company has officially responded.
· The first final determination of transition review made by the UK government after the Brexit.
· The first case (and the only one so far) to have the anti-dumping measure successfully revoked without any further measure since the UK started to independently initiate trade remedy investigations
