Gilbert LEUNG
Gilbert is a partner of the firm’s dispute resolution practice and he specializes in commercial litigation and dispute resolution. He has extensive experience in shareholders’ disputes, insolvency matters, commercial fraud, contentious banking matters, real estate disputes, regulatory and investigatory matters. Gilbert advises listed companies, developers, local and international banks and financial institutions, accounting firms, multijurisdictional corporations, and philanthropists. In addition to his litigation experience, Gilbert also focuses on antitrust law and has been advising corporate clients on issues arising from the Competition Ordinance.
Prior to joining Zhong Lun in 2015, Gilbert has worked with Deacons since 2001.
Representative Matters
Act for a leading Chinese bank to successfully struck out the plaintiff’s claim for HK$5 billion on the grounds of issue estoppel; time limitation; claim disclosing no reasonable cause of action; and abuse of process.
Act for the world largest lithium chemical producer that has been focused on the development, production and sales of lithium chemical products in a dispute involving an acquisition of shares of a company in the lithium chemical industry at the consideration of US$72 million
Act for one of the 2 shareholders in a joint venture shipping company (with net asset of over US$50 million) in a deadlock situation and acting for the shareholder in commencing legal proceedings against the other shareholder, including a successful inter-partes interlocutory injunction application for an order to restrain the other shareholder from relying on the invalid deadlock notice to trigger the buy-sell event under the Shareholders’ Agreement pending determination of an arbitration. Upon the parties’ agreement to resolve the dispute amicably, we accordingly advised our client on the sale and purchase of the JV shipping company
Act for several companies founded by a late tycoon, philanthropist and Vice Chairman of the National Committee of the Chinese People’s Political Consultative Conference of the PRC in a number of disputes and issues between his family members over his estate and interests in his entire business empire by which these companies are owned and controlled. These disputes were acrimonious and attracted wide publicity in Hong Kong and PRC with the involvement of former Chief Executive and Secretary of Justice in attempting a settlement between all parties but in vain
Act for the world’s second-largest memory semiconductors manufacturer for personal computers and smart phones to claim against various parties for inter alia, breach of confidence and seeking injunction relief, damages and the account of profits. Despite oppositions were raised by the other parties, our client successfully obtained both ex-parte and inter-partes interlocutory injunctions orders
