Fanglong SUN

Mr. Sun is a partner of Zhong Lun Law Firm as well as legal counsel for Qingdao Municipal Government, deputy to Qingdao Municipal People’s Congress, and vice president of Qingdao Lawyers Association.
Mr. Sun mainly practices in areas of international trade, maritime, dispute resolution, cross-border investment and corporate legal counsel, among which he focuses on major, complex, difficult and foreign-related civil and commercial dispute resolution cases.
Mr. Sun was awarded 2016 ALB China Top 15 Litigators. He has also been recommended by Chambers as Tier 1 lawyer in Corporate / Commercial area for many years.
He has been selected by the Ministry of Justice as one of the Leading Foreign-related Lawyers for his outstanding experience in foreign-related legal services. Mr. Sun was also named to the National Talent List of 1,000 Foreign-related Lawyers.

Representative Matters

Dispute Resolution

  • Represented Qualcomm in its disputes against Meizu over licensing conditions and monopoly

  • Represented Qualcomm in its dispute against Apple Electronics Products Commerce (Beijing) Company Limited over abuse of a dominant market position and licensing conditions of standard-essential patents, with the amount in dispute exceeding CNY 1 billion

  • Represented Tangshan Ganglu Iron & Steel Co., Ltd. in a private lending dispute at the second instance before the Supreme People’s Court, reducing the client’s loss by nearly CNY 500 million

  • Represented Tianjin Kimyen Welding MATERIALS Co., Ltd. in a series of cases regarding recovery of state-owned assets, which involved more than CNY 1 billion

  • Acted on behalf of Banco de Costa Rica in applying for retrial and represented the client during the retrial proceedings before the Supreme People’s Court in its disputes against Anhui Foreign Economic Construction (Group) Co., Ltd. and China Construction Bank Corporation Anhui Branch regarding independent guarantee fraud. The case was selected as the Supreme People’s Court’s guiding case No. 109 and included in its Gazette

  • Represented Chengde Iron & Steel Group Co., Ltd. in a loan contract dispute before the High People’s Court of Hebei Province, which involved CNY 750 million

  • Represented Qingdao West Coast Development (Group) Co., Ltd. in a contract dispute against Beijing Huiju Technology Industry Development Co., Ltd. and Qingdao Huiju Smart City Industry Development Co. Ltd. The court of first instance ordered the two defendants to pay about CNY 1.6 billion in damages for breach of contract, which was upheld by the court of second instance. Further represented the client in the enforcement proceedings of the case

  • Represented Zhongnan Holdings Group Co., Ltd and Qingdao Zhongnan Century City Real Estate Investment Co., Ltd. in a series of disputes against a government entity over joint venture and cooperative real estate development, with the court of second instance ruling for the clients in all three cases, which secured more than CNY 2 billion for the clients

  • Represented AVIC International Holding Corporation in a BAC arbitration case against AVIC Forestry and Hubei Fuhan Wood Industry (Group) Development Company Limited regarding disputes over revocation of a capital increase contract, and won an arbitral award that reduced the client’s loss by over CNY 600 million

  • Represented a Qingdao-based company in its dispute against a Binzhou-based company over a processing contract before the High People’s Court of Shandong Province, with the dispute involving CNY 180 million

  • Represented a shareholder in an appellate case concerning its disputes over  equity interests against its foreign counterpart before the Supreme People’s Court, with the dispute involving CNY 150 million


Intellectual Property

  • Provided whole-process legal services for the IPR infringement litigation between a Shandong-based rubber group and a U.S. company before the United States District Court of Eastern District of Virginia

  • Represented a group company in a series of container manufacturing patent disputes against a Qingdao company

  • Represented Unicom (Qingdao) in a series of intellectual property litigation  over copyright infringement, among other matters

  • Represented a U.S. company in a series of patent infringement disputes against a Weifang company before Chinese courts

  • Represented a Shandong company in around 20 cases concerning intellectual property rights, including patent, trade secrets and unfair competition, against a foreign company

  • Represented a large commercial group company in an unfair competition and trade name infringement lawsuit before Chinese courts against a Japanese company, which was selected as one of the top ten typical cases of intellectual property rights in Shandong Province


WTO/International Trade

  • Represented a central enterprise in its arbitration case of a dispute over a contract for international sales of goods against an Argentinean group before CIETAC, with a disputed amount of USD 6 million

  • Represented a Qingdao company in its arbitration case against a Hong Kong mining company before CIETAC, with a disputed amount of USD 7 million

  • Represented a Qingdao import and export company in its arbitration case of a dispute over a contract for international sales of goods against a Swiss international mining group (a Fortune Top 500 company) before HKIAC, with a disputed amount of USD 1.8 million

  • Represented a television station in its arbitration case of a contract dispute against a Canadian company before SIAC, with a disputed amount of nearly USD 1 billion


Maritime

  • Represented CSSC Qingdao Beihai Shipbuilding Co., Ltd. in its dispute over contracts for the repair of ships for M.V. "TAMIL ANNA" against Pophal Shipping Co. India

  • Appointed by the Qingdao Judicial Bureau to act as legal counsel for a special task force handling the M.V. “Chang Ying" incident in which the ship sank on August 8, 2009 under the influence of a typhoon, killing 22 crew members on board. The incident was closely monitored by the Chinese central government and Shandong Provincial People’s Government. Qingdao Municipal People’s Government set up the special task force led by Vice Mayor Shaojun Hu, and work performed by the task force was well recognized by the government leaders

  • Appointed by the State Oceanic Administration of China to represent the Chinese government to file a marine ecological claim against ConocoPhillips China Ltd. with regard to the Penglai 19-3 oil spill incident, receiving an award of CNY 1.683 billion. The case was selected as a “2012 Outstanding Transaction / Most Notable Case" by Business Law Journal [Series 4, Issue 1 (December 2012 / January 2013)]

  • Represented a Hebei group company in its dispute over a contract of carriage of goods by sea against a Vietnamese shipping company before Qingdao Maritime Court, Shandong High People’s Court and the Supreme People’s Court, with the amount in dispute being USD 1.2 million

  • Represented a Dalian group company in its arbitration case against a Panamanian shipowner regarding a dispute over a contract of affreightment with the seat of London, UK. The disputed amount is USD 17 million

  • Represented a Dalian company in its dispute against a South Korean company regarding a maritime guarantee contract before Dalian Maritime Court, with the amount in dispute being USD 8 million

  • Represented a Qingdao insurance company in its dispute against a Panamanian shipowner over recovery of compensation from marine cargo insurance before Ningbo Maritime Court, with the amount in dispute being USD 3.4 million
