Partner Peter Ni was invited to speak at IPBA’s 23nd Annual Conference in Korea last week. Peter’s topic was “The New Developments in China’s General Anti-avoidance Rules". Peter discussed such latest developments as well as how to balance the full compliance and the protection of taxpayer’s interest. Peter’s presentation was well received by the attendees. The GAAR has recently become a new issue for MNCS and funds that do business in China. Some of the rules issued by the State Administration of Taxation appear to be a little bit too harsh. Also, some of the key concepts are still lacking clear explanations and guidance. Nevertheless, there is an increasing interest in enforcing such rules by the Chinese tax authorities across the country.
