Partner Xu Shengfeng was invited to attend the researching conference for drafting of Bankruptcy Law judicial interpretation by Supreme People‘s Court
Partner Xu Shengfeng was invited by Supreme People’s Court to attend the researching conference (the conference hereinafter) hold on 26th April 2013 for drafting of People’s Republic China Bankruptcy Law judicial interpretation. The conference was organized by the judges from the second civil division of Supreme People’s Court. There were six law firms and three liquidation firms to attend the conference from all over the country.
It is known that the judicial interpretation for Bankruptcy Law is planned to be issued in different parts, which means that once the part of the judicial interpretation was completed it would be issued respectively. The researching part of the conference belongs to the third judicial interpretation that mainly regulates the related legal issues about administrator and bankruptcy expenses. Regarding Partner Xu Shengfeng’s full experience in the field of corporate bankruptcy, he was invited to attend the conference. Partner Xu Shengfeng and attorney Zhang Sheng made suggestions for revision of the judicial interpretation on the issues about appointing administrator, the identification of the bankruptcy expenses, additional distribution and remuneration of administrator and so on. They also reflected some practical legal problems to Supreme People’s Court about the identification of the common benefits debt that occurs over the administrator’s performance of an executor contract, the confirmation of the senior executives’ wage and reward and other legal problems urgently to be solved.
