Partner Sun Wei Attended UNCITRAL Meeting on Arbitration and Conciliation
The 63rd meeting of the Arbitration and Conciliation Working Group (Working Group II) of the United Nations Commission on International Trade Law (UNCITRAL) was held during 9 September 2015 and 11 September 2015 in Vienna International Centre. Representatives from 51 member states and observers from dozens of NGOs participated in the meeting. The main topic of this session was the enforceability of settlement agreements resulting from international commercial conciliation/mediation. In light of the increasing importance of conciliation in international dispute resolution, UNCITRAL may push for an international convention on settlement agreements, drawing on the successful experiences from the New York Convention. This meeting attracted extensive attention from people who was interested in alternative dispute resolution.
Having stationed in the Beijing office of Zhong Lun Law Firm, partner Sun Wei attended the meeting as the representative of China International Economic and Trade Arbitration Commission. His representations focused on the following topics: whether settlement agreements reached in litigation/mediation should be included in the scope of the proposed convention, the international elements of settlement agreements, formality requirements of settlement agreements, and that the convention should not be limited to enforcement of monetary obligations etc..
