Zhong Lun Wins A Lawsuit before Hunan Provincial High Court relating to A Share Transfer Dispute in the Way of “Mediation plus Judgment”
Recently, Zhong Lun represented two clients, Hunan Best World Industrial Co. Ltd. and Changsha Water Conservancy Investment and Real Estate Development Co., Ltd., as the defendants in winning a lawsuit relating to a share transfer dispute before the Hunan Provincial High Court. The dispute amount, including both claims and counterclaims, totals RMB 305,000,000.
With the help of Zhong Lun’s skillful techniques in negotiations and mediation, the clients were able to reach settlement with the opposing party on part of the dispute. With respect to the rest and key portion of the dispute, the Court adopted Zhong Lun’s argument and dismissed all the claims of the opposing party. Most of the clients’ counterclaims were also supported by the Court. No appeal was filed by either party, and this first instance judgment has therefore become effective.
In recent years, mediation has become a preference of PRC courts in dispute resolution and has been widely used by the courts around China, but “mediation plus judgment" were seldom used. This new case thus becomes one of the seldom precedents settled in the way of “mediation plus judgment".
