Carol ZHU

Carol Zhu is a partner in the firm's employment practice group. Her practice focuses on all aspects of labor and employment law from hiring to firing, including establishing and enforcing HR policies, drafting and reviewing HR related documents, employee benefit and incentive plan, confidentiality and restrictive covenants, privacy and data protection, labor dispatch and outsourcing, employee transition in mergers, acquisitions and restructurings, mass redundancies, collective consultation, especially on managing complicated employment dispute and handling related labor arbitration and litigation. She also assists clients with investigation of employee's misconduct and due diligence on employment compliance. In addition, she often helps international clients with global mobility and cross-border employment issues.

Carol has been ranked as a tier-one or leading labor and employment lawyer for consecutive years by Chambers, The Legal 500 and AsiaLaw, etc. She is also an officer of the Diversity and Equality Law Committee of the International Bar Association.

Representative Matters

  • Advised a world-famous elevator company on the issues related to employment contract, flexible working hours system, work- related injuries and employees under medical treatment period etc.

  • Advised a foreign-invested education company engaging in students’ overseas exchange programs on reduction of employees’ salary due to reduction in business caused by pandemic and termination of employment contracts with its foreign employees due to his incompetency

  • Advised a US molds company on phantom share incentive scheme for its executive

  • Advised a start-up pharmaceutical company on terminating several senior managers and negotiated with these senior managers on mutual separation and stock options arrangement for the company

  • Advised a leading US labor and employment boutique on cross-border employment issues such as EOR or direct employment in China

  • Advised a well-known foreign invested telecommunications company on its large- scale layoff in China, including attending all employee conference, employee representative meetings, communicate with trade union, labor authorities and police and participating termination negotiation with the employees

  • Represented a world-famous investment company on labor arbitration and litigation filed by a former senior employee for the dispute on huge amount of bonus and overtime compensation

  • Represented a former executive in the labor arbitration and litigation caused by his former employer’s denial of his resignation and his rights to exercise his vested stock options

  • Represented a subsidiary of an Australian architectural planning and design group in China in an employment dispute with its expatriate general manager

  • Represented a Fortune 500 company in handling labor arbitration and litigation cases involving a 5 million commission dispute filed by a former employee

  • Advised a leading US manufacturer of microprocessors in investigation and termination of its office manager and represented the company in the subsequent mediation with the employee in the labor arbitration filed by the employee

  • Represented a leading global luxury goods company in an investigation of alleged commercial bribery by a senior employee of its subsidiary in China and advised on the termination of the individual's employment contract

  • Represented a well-known German medical device company in providing anti-corruption education and training to local distributors in China

  • Provided services such as visa, work permit, residence permit application, extension, change, and cancellation to multiple multinational corporations
