Clara Leung

Clara Leung has extensive experience in handling a broad range of complex commercial disputes, probate disputes, banking claims, insolvency and winding up proceedings, insurance and personal injury claims, employment disputes, as well as cross border litigations. She also frequently advises clients on both contentious and non-contentious employment related matters, personal data privacy, trade mark, copyright, and compliance issues relating to pharmaceutical companies.

In addition to being admitted as a solicitor in Hong Kong, Clara passed the Guangdong–Hong Kong–Macao Greater Bay Area Legal Professional Examination in 2024.

Clara frequently represents leading banks, financial institutions, insurance companies, pharmaceutical companies, multinational corporations, state owned enterprises, and high net worth individuals. She has also served as tribunal secretary in arbitration proceedings administered by the Hong Kong International Arbitration Centre (HKIAC). In addition, she is often invited by financial institutions and law societies in the Chinese mainland to deliver seminars.

Representative Matters

  • Successfully applied to strike out a claim of over RMB 1 billion for a client; the relevant Court of Final Appeal decision provided clear guidance on the limitation period for claims involving breaches of fiduciary duty by trustees and has become one of Hong Kong's leading authorities on this legal principle

  • Advised and represented a client in multiple proceedings; assisted the client in conducting legal proceedings before the Judicial Committee of the Privy Council in London, the Court of Appeal of the British Virgin Islands, the Hong Kong Courts, and the Singapore Courts, and successfully resisted applications in the Hong Kong courts for a bankers' books order and an interim injunction of assets exceeding HKD 380 million

  • Represented a leading Chinese energy group in insolvency proceedings in Guernsey involving claims exceeding EUR 16 million, and successfully assisting the client in recovering over 75% of its debts

  • Represented group companies of a late prominent entrepreneur and philanthropist in a high-profile

  • High Court action 

  • Represented group companies controlled by the family of a late entrepreneur and philanthropist in recovering over HKD 100 million in debt from a former company director

  • Represented banks in litigations with customers and third parties

  • Represented banks in defending claims brought by vexatious litigants

  • Represented a Hong Kong Mandatory Provident Fund and retirement protection services institution in garnishee proceedings

  • Represented a Hong Kong authorised insurer in personal injury and employees' compensation claims brought against insured persons

  • Advised a multinational pharmaceutical company on employment disputes and compliance investigations

  • Advised leading pharmaceutical companies on trademark infringement claims, pharmaceutical regulatory compliance and regulatory issues relating to advertising pharmaceutical products in Hong Kong

  • Advised a global leading technology group on litigation risks associated with a high-profile merger and acquisition transaction

  • Successfully represented a major Chinese financial institution in obtaining a winding up order against an unregistered foreign company in Hong Kong on just and equitable basis
