Bo WU
Bo Wu is a licensed Chinese attorney and patent attorney, with over 13 years of experience focusing on intellectual property. Bo has a multidisciplinary academic background in engineering and law. Having worked at the Patent Examination Cooperation (Beijing) Center of the Patent Office, CNIPA, Bo is experienced in patent examination, re-examination, PCT searches, and patent prosecution. Bo has also practiced in law firms for 7 years, specialized in patent invalidation, patent infringement, patent administrative litigation, trade secret litigation, patent licensing, FTO, and due diligence.
Representative Matters
IP Lawsuit and Dispute Resolution
• Represented NETGEAR in response to 22 patent infringement lawsuits and patent infringement administrative complaints filed by the internationally renowned NPE (Global Innovation Convergence Co., Ltd) in multiple courts; currently, except for 6 cases that are being heard by the Jinan Intermediate People's Court, all the other 16 cases have been won.
• Represented Sogou in more than 20 patent invalidation and infringement lawsuits against Baidu, involving human-computer interaction technologies such as input methods, the Internet and smart terminals; this series of cases was called “China’s first Internet patent case" and was rated as an Outstanding Deal in Commercial Law of 2019 and 2020; some of the cases were voted by the Supreme Court of China as exemplary cases in intellectual property law
• Represented Sogou in a lawsuit seeking declaration of non-infringement against Jiugong involving the input method technology; the Supreme People’s Court of the Intellectual Property Court made a final judgment confirming that Sogou does not infringe Jiugong’s patent; this case has seen the final ruling of the Supreme Court in retrial, denying Jiugong’s request for review
• Represented the world's leading orthodontic company "Invisalign" in responding to a patent infringement administrative complaint and invalidation case initiated by a domestic NPE at the Beijing Intellectual Property Office, and won the case; (This case is the third batch of guiding cases on administrative protection of intellectual property rights by the CNIPA. [GZFBZ [2023] No. 54])
• Represented the U.S. company NETGEAR in handling patent administrative enforcement and parallel patent invalidation cases filed by well-known foreign NPE in multiple local intellectual property offices, a total of 4 cases involving wireless router products and communication-related technologies (reported by multiple media, including the United States "IAM" (Intellectual Property Asset Management), China's "IPR Daily", referred by the media to be the first trial of an international NPE utilizing China specialized the "patent infringement administrative enforcement procedure")
• Represented JCET Group Co.,Ltd. in handing a series of patent invalidity, patent infringement, patent ownership and trade secret disputes with YX, involving semiconductor chip manufacturing process
• Represented Kautex, a tier 1 auto parts manufacturer, in a series of patent infringement litigation, patent administrative litigation and patent invalidation cases, involving auto parts and mechanical structure
• Represented Taiwan Semiconductor Manufacturing Company, Ltd. in responding to a patent infringement war in the semiconductor field initiated by a world-renowned semiconductor company, involving semiconductor design processes and devices, and finally helped the client reach a global settlement with the semiconductor company
• Represented Organic Waste Systems NV, a Belgian waste disposal company, in a series of patent infringement lawsuits against multiple infringers in the Zhengzhou Intermediate People’s Court, involving environmental protection, green energy technology, and government projects, and won damages in RMB 6 million for the client, and the cases have been upheld by the Supreme People’s Court in the second instance
• Represented NETGEAR in a patent infringement case filed by Shenzhen Dunjun Technology Co., Ltd., involving wireless router products and related technologies
• Represented Taiwan Semiconductor Manufacturing Company, Ltd. in handling patent invalidity and infringement litigation in the semiconductor field, including forensics, slicing, technical feature comparison, etc.
• Represented Schott, a world-renowned supplier of special glass, in its intellectual property business in China, including related contract legal risks, patent stability analysis, patent infringement analysis and comparison, etc., involving mobile phone cover glass manufacturing processes and materials
• Represented 720 Degrees suing Nintendo’s electronic game devices for patent infringement, involving Nintendo’s Switch with a cumulative global sales of more than 60 million units, and this case should be the first patent infringement lawsuit against Nintendo in recent years
• Represented Kelly Slater Wave Co. LLC of the United States in a potential infringement case, the technology involves wave machine-related wave generators
• Represented the world-renowned petrochemical company Saudi Basic Industries Corporation (SABIC) in a series of patent infringement cases involving polymer manufacturing and separation technology
• Represented the world-renowned petrochemical company Saudi Basic Industries Corporation (SABIC) in multiple patent invalidation cases, and successfully invalidated the target patents in whole or in part, involving the manufacturing process of polyarylene ether and solvent recovery technology
• Represented an internet company in a series of patent invalidation and administrative litigation against Alibaba, involving online payment, identity verification, online certificate authentication, etc.
• Represented ExxonMobil, a global petrochemical giant, in potential patent infringement disputes, involving the heterophasic polypropylene technology
• Represented BASF, a lobal petrochemical giant, in conducting pre-litigation work such as patent infringement investigations, and prepared to file a patent infringement case involving surface treatment agent technology
• Represented Energy Recovery Inc, a well-known American energy recovery company, in a patent infringement case involving energy recovery and seawater desalination technology
• Represented Kulicke and Soffa Industries, Inc. in issuing attorney's letters and providing legal counseling on potential patent infringement and software copyright infringement cases.
• Represented Ninebot and Segway in a patent infringement lawsuit before Beijing Intellectual Property Court involving self-balancing personal transporter technology
• Represented Verily, a life science company under Google, in a patent litigation, involving medical electronic devices
• Represented Hyperice, a professional rehabilitation technology company for athletes, in patent invalidation and related infringement lawsuits, involving fascia guns
• Represented a well-known Sichuan pharmaceutical company in China in a criminal dispute on trade secrets involving pharmaceutical equipment and processes, and the judge of first instance announced all the defendants guilty of infringing trade secrets
• Represented JCET Group Co.,Ltd. in handing a series of patent invalidity, patent infringement, patent ownership and trade secret disputes with YX, involving semiconductor chip manufacturing process
• Represented a U.S. chemical company in a trade secret dispute involving processes and equipment for the preparation of new chemical materials.
• Represented a Norwegian chemical company in a case where a former employee stole the company’s trade secrets and applied for a patent without authorization
• Represented Shenzhen Xinhao, a high-tech company in the optoelectronics field, in a lawsuit for breach of contract with Corning, a global giant in the field of special glass. The contract involved a trade secret dispute over secondary glass strengthening technology

• Represented Qualcomm in preparing for a standard-essential patent litigation involving frequency-hopping spread spectrum
• Represented an automobile group in 5G SEP license negotiations involving wireless communication technologies
• Represented Fudan Microelectronics in negotiating with U.S. and European companies on patented technologies related to international standards for radio frequency technology, and drafting the license agreement
• Represented internationally renowned chip companies in response to antitrust investigations involving technology, intellectual property rights, and standard patents by relevant state authorities
• Represented NAGRA, a European group company, in patent package licensing and transfer matters, involving more than 500 global patents, involving electronic payment cards, NFC, etc.
• Represented Sumitomo Chemical, a world-renowned chemical company, in technology-related disputes, including drafting and reviewing related intellectual property agreements and conducting due diligence of related intellectual property rights, etc.
• Advised China Resources Pharmaceutical Group in foreign drug import transactions to obtain relevant patents and know-how on medicines
• Advised the American Ayla Networks, Inc and the related joint venture company on review and negotiation services for its APP license agreement and intellectual property layout and related licensing agreements
• Represented Shanxi Wright Optoelectronics, a domestic OLED material giant, in patent stability and non-infringement analysis and patent license negotiations, and successfully assisted the client to reach a patent license with a company, involving organic compounds and manufacturing processes in the OLED field
• Represented a company under China National Nuclear Corporation in technology introduction from the United States and Singapore and licensing negotiations, involving the field of cadmium telluride solar cells
• Represented Enze Fund, a subsidiary of Sinopec, in conducting due diligence on the legal status, ownership, transfer and licensing status of intellectual property rights in overseas target companies invested in, assessing the stability of the target company’s core patents, and conducting evaluate whether the patent infringes the patent rights of a third party, involving the field of fuel ethanol
• Represented Northwest Electric Power Design Institute to provide legal consulting services, including review and negotiation of foreign-related software development agreements, font infringement consulting, etc.
• Represented Rambus on technology licensing matters with partners in China’s joint venture projects, involving DRAM chips
• Represented Actions Technology Co., Ltd. to provide contract review services, with technical fields involving integrated circuits and chips
• Represented RIGOL in handling copyright infringement matters with third-party software companies, successfully reached a settlement agreement for the client, and assisted in a successful listing
