Feng YU
Mr. Yu once was a judge at the Qingdao Maritime Court for seven years, and then worked as an in-house counsel in a large company. He has been working in law for over 20 years. As an experienced former judge, in-house counsel and now a lawyer, Mr. Yu has a unique understanding of the application of law and the intention of his clients. He brings this expertise to the way he deals with complicated commercial disputes. During his career as a judge, many of his judgements were recognised as excellent judgements in the court system, and he was awarded first-class merit citation in the court system because of his outstanding work. Since he started practicing law in 2005, Mr. Yu has been mainly focusing on the dispute resolution area, but he also has provided non-litigation and general corporate legal services for many Chinese and foreign clients in commercial, shipping and trading, among other areas. He is also an expert in administrative dispute resolution. Mr. Yu is capable of handling both domestic and international arbitrations. He represented clients in many international arbitration proceedings, including those seated in London and Hong Kong or conducted before Chinese mainland arbitration institutions.

Represented China Yangtze Shipping Group Co., Ltd. in the first and second instances in respect of a ship operation loan agreement with a disputed amount exceeding CNY 100 million before Wuhan Maritime Court and Hubei Higher People’s Court respectively and obtained a favorable judgment
Represented China Changjiang National Shipping Group Yichang Shipyard in a shipbuilding dispute before Wuhan Maritime Court and Hubei Higher People’s Court and obtained a favorable judgment
Represented Shanghai Changhang Wusong Ship Engineering Co., Ltd. in a ship repairing dispute before Shanghai Maritime Court and obtained a favorable judgment
Represented a bunker oil supplier and recovered CNY 30 million purchase price by arresting the relevant vessel and bringing litigation
Represented a shipyard in Zhejiang in a Hong Kong arbitration proceeding regarding a shipbuilding contract with a CNY 58 million disputed amount and obtained a favorable award for the client
Represented a shipyard in Jiangsu in a series of 12 shipbuilding contract disputes with USD 70 million at stake, and assisted the client to reach amicable settlements with Danish and Turkish shipowners
Represented a bank in Zhejiang and instructed the barrister in a refund guarantee dispute with USD 20 million at stake before English High Court, and reached an amicable settlement with the Greek shipowner
Represented a shipyard in Guangdong in a Hong Kong ICC arbitration proceeding against a Nigerian bank regarding a payment guarantee, and recovered USD 14 million for the client
Provided an expert opinion in relation to PRC law in a dispute regarding contract of carriage of goods by sea before a Singapore court
Provided an expert opinion in relation to PRC law in a dispute regarding ship mortgage before a Malaysian court

Represented GMR Kamalanga Energy Limited in a demand guarantee fraud dispute with over USD 80 million at stake before Shandong Higher People’s Court and the Supreme People’s Court, and obtained a favorable judgement for the client
Represented Shanghai Oriental Futures Co., Ltd. in a dispute regarding a corporate resolution before Shanghai Pudong New District People’s Court and Shanghai First Intermediate People’s Court, and obtained a favorable judgement for the client
Represented China Aviation Oil (Singapore) Corporation Ltd. before Chengdu Intermediate People’s Court for application of recognition and enforcement of a foreign arbitration award
Represented a bank in the bankruptcy proceeding of a Chinese shipyard and registered a debt in the amount of CNY 420 million
Represented an Italian fabric machine manufacturer in a CIETAC arbitration proceeding against a Chinese buyer in relation to a complicated quality dispute with EUR 3 million at stake, and reached an amicable settlement to the satisfaction of the client
Represented a sewage treatment plant in an administrative litigation proceeding against the local environment authority regarding an administrative penalty imposed on the client for five months, obtained a favorable judgment in the first instance, and forced the environment authority to withdraw the penalty during the second instance
Represented a spandex producer in Jiaxing in an environment public interest litigation brought against it by an NGO and assisted the client to reach an amicable settlement
