Zhong Lun Partner ZHANG Baisha Invited to Give Lecture on Concentration Review for Local Commerce Administrations and State-owned Enterprises in Guangdong Province
On April 28th 2015, Mr. Zhang Baisha, partner of Zhong Lun Law Firm, was invited to give a lecture entitled “Theories and Practices of Concentration Review" in the 1st Training Session of Concentration of Undertakings held by the Department of Commerce of Guangdong Province. More than 160 participants, including officers from the Department of Commerce of Guangdong Province and local commerce administrations of twelve cities (Guangzhou, Shenzhen, Foshan, etc.), as well as representatives from trade associations of the ten key industries of Guangdong Province, provincial state-owned enterprises, and field-leading enterprises attended the Training Session.
Combining China’s current competition policies, anti-monopoly laws and regulations, economic theories, and practice experience in concentration review, Mr. Zhang analyzed the legal problems state-owned enterprises may encounter in concentration review from both substantive and procedural perspectives. The lecture covered the practical issues including control analysis in the context of state-owned enterprises, turnover thresholds for notification, relevant market definition, factors to be considered in competition analysis, the theory of harms, and the simple review procedure, etc. Mr. Zhang also provided suggestions for firms in their concentration review process in connection with hot issues such as the mixed-ownership reform of state-owned enterprises, innovation-driven policy, and the balance between competition policies and industrial policies.
