In April 2018, the Annual Report on Recognition and Enforcement of Foreign Arbitral Awards in China (2017) drafted by Mr. Sun Wei, a partner of Zhong Lun Law Firm, was published on Kluwer Arbitration.
The year of 2017 marked the 30th year since China joined the New York Convention in 1987. Over these years, China has gradually established and improved the legal framework and system for the recognition and enforcement of foreign commercial arbitral awards. Multiple landmark cases have also formed important principles and rules. At the end of 2017, the Supreme People’s Court issued several judicial interpretations including the Provisions on Several Issues Concerning the Judicial Review of Arbitration Cases, which addressed issues in judicial review of foreign arbitral awards. This annual report introduces these new developments. Combined with a study of the cases concluded in 2017, it also analyzes how Chinese courts interprets and applies the New York Convention in practice. In addition, this annual report introduces the development of civil enforcement measures in China.
