Zhong Lun Assists Several International Non-Profit Organizations in Building Personal Information Compliance Systems and Completing Standard Contract Filings
Recently, Zhong Lun has assisted several international non-profit organizations (“NGOs”) in successfully building their personal information compliance systems and completing filings of Standard Contract for the Cross-border Transfer of Personal Information, in line with China’s data and privacy laws and regulations.
Throughout this series of mandates, the Zhong Lun team played a key role in the interviews and risk screenings conducted for personal information protection and cross-border transfer compliance purposes, helped to build and refine data protection systems, drafted and modified Personal Information Protection Impact Assessment Reports, and compiled materials for the filings of Standard Contracts. These matters concerned several complex areas, such as public health, healthcare, environmental protection, and clean energy. In addition, the Zhong Lun team assisted the China-based representative offices of the NGOs (“Representative Offices”) to communicate with the Offices of the Cyberspace Affairs Commission (“CAC”) as well as other industry regulators and registration authorities across different provinces in China. By virtue of such efforts, the team eventually assisted several Representative Offices to complete the filing of the Standard Contract with the CAC and obtain the filing receipts.
Furthermore, the Zhong Lun team also promptly adjusted the work plan and communication strategies in accordance with the newly-introduced “Provisions on Promoting and Regulating Cross-border Data Flows” (《促进和规范数据跨境流动规定》), actively communicated with the local CAC and relevant authorities, secured the exemption of relevant obligations for eligible Representative Offices, and developed comprehensive solutions balancing legal compliance and operational convenience for specific business scenarios. These customized cross-border data compliance solutions provided by the Zhong Lun team were highly recognized by the NGOs.
